THE FEDERAL CONSTITUTION (‘Constitution’)

Federal Court (‘FC’): The declaration in Article (‘Art’) 4(1) that the Constitution is the supreme law of the nation are not empty words.

The declaration contains ‘powerful normative elements’, protecting the constituent fundamental features (‘Fundamental Features’) that are embedded in the structural design of the Constitution. The nation operates under the doctrine of constitutional supremacy, not Parliamentary sovereignty.
